INDEMNITY, WAIVER & ASSUMPTION OF RISK FORM

ACKNOWLEDGEMENT OF RISK

I, the undersigned, acknowledge that participation in tours, excursions, activities and adventures organised by Nomjey Tours and Adventures may involve inherent risks, including but not limited to:

  • Travel by vehicle, boat or other transport
  • Outdoor, nature‑based or adventure activities
  • Physical exertion
  • Weather conditions
  • Interaction with wildlife, terrain, and unfamiliar environments

I understand that these risks may result in personal injury, illness, death, loss, or damage to property, whether caused by negligence or otherwise.

ASSUMPTION OF RISK

I voluntarily and knowingly assume all risks associated with participation in any activity provided or arranged by Nomjey Tours and Adventures.

INDEMNITY & RELEASE

I hereby indemnify, hold harmless, and release Nomjey Tours and Adventures, its owners, directors, employees, guides, contractors and agents from any and all claims, whether arising from:

  • Personal injury
  • Death
  • Property loss or damage
  • Financial loss

arising directly or indirectly from my participation in any tour or activity, except where prohibited by South African law.

MEDICAL FITNESS

I confirm that:

  • I am medically fit to participate in the activities selected
  • I have disclosed any medical conditions, allergies, disabilities, or special needs
  • I accept responsibility for my own medical costs

Nomjey Tours and Adventures may arrange emergency medical assistance where reasonably possible, but assumes no responsibility for medical outcomes or costs.

INSURANCE

I understand that Nomjey Tours and Adventures does not provide personal travel insurance, and it is my responsibility to ensure I am adequately insured.

PHOTOGRAPHY & MEDIA

I grant permission for Nomjey Tours and Adventures to use photographs or video recordings taken during activities for marketing, promotional, and social media purposes, unless I notify them otherwise in writing.

GOVERNING LAW

This Indemnity shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
